Decree Flows 2023: the new decree for the income of the foreign workers has been published

In the Official Journal no. 21 of 26 January 2023, the DPCM of 29 December 2022 was published, with which the quotas of foreign workers who can enter Italy to work have been fixed. The maximum amount of admission for 2023 will be 82,705 units, 44,000 of which are reserved for entrances for seasonal work purpose and 38,705 for entries for non-seasonal and autonomous work.

The novelty introduced by the new decree flows concerns the need for the employer to verify at the Employment Centre that there are not other workers already present on the national territory available to fill the job for which the foreign worker is intended to be hired.

This verification will be carried out by sending a request for staff to the Employment Centre, through a special form. If the Employment Centre does not respond to the request within 15 working days or if the worker notified by the Employment Centre is not eligible for the work offered or does not attend the interview without justified reason, the foreign worker may be cleared for work.

The verification of unavailability of workers present on the national territory is not necessary for seasonal workers and for workers trained abroad. Applications can be submitted from 27 March 2023, that is, 60 days after the publication of the Decree Flows in the Official Journal.

At the end of the procedure, after thirty days from the submission of the applications without the obstructive reasons having emerged, the authorization is issued automatically and sent – electronically – to the Italian diplomatic representations of the countries of origin that, will have to issue the entry visa within 20 days of the application.
